1. Acceptance of Terms
By downloading, accessing, or using the Hamptons Coastal mobile application (“App”) and website, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.
2. Description of Service
Hamptons Coastal is an editorial publication that provides news, analysis, and market insights related to Hamptons real estate. The App delivers articles, market data visualizations, and curated property listings from affiliate broker partners.
3. User Accounts
To access certain features of the App, you may be required to create an account by providing your name and email address. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
4. Editorial Content
All articles, analysis, and commentary published through Hamptons Coastal are for informational purposes only and do not constitute financial, legal, or real estate advice. Market data is compiled from public records and third-party sources believed to be reliable, but accuracy is not guaranteed.
5. Not a Brokerage
Hamptons Coastal is NOT a licensed real estate brokerage. We do not represent buyers, sellers, landlords, or tenants in real estate transactions. Broker connection requests submitted through the App are forwarded to independent affiliate broker partners. Hamptons Coastal is not responsible for the services provided by affiliate brokers.
6. Intellectual Property
All content in the App, including but not limited to text, graphics, logos, images, and data compilations, is the property of Hamptons Coastal or its content suppliers and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without prior written consent.
7. User Conduct
You agree not to: (a) use the App for any unlawful purpose; (b) attempt to gain unauthorized access to any portion of the App; (c) interfere with or disrupt the App's operation; (d) scrape, copy, or extract data from the App without permission.
8. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, either express or implied. Hamptons Coastal does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of Liability
To the fullest extent permitted by law, Hamptons Coastal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to decisions made based on information provided in the App.
10. Indemnification
You agree to indemnify and hold harmless Hamptons Coastal, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
11. Modifications
Hamptons Coastal reserves the right to modify these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
